What do dangerous chemicals and dangerous goods refer to respectively?

   Customs: Dangerous chemicals refer to highly toxic chemicals and other chemicals that have toxic, corrosive, explosive, flammable, and flame retardant properties and pose a threat to human health, facilities, and the environment.

   Dangerous goods refer to substances and items that have hazardous characteristics such as explosion, flammability, toxicity, infection, corrosion, and radioactivity, and are prone to causing personal injury, property damage, or environmental pollution during transportation, storage, production, operation, use, and disposal, requiring special protection.

What is the difference between hazardous chemicals and dangerous goods?

   Customs: Dangerous chemicals only contain chemical substances, while dangerous goods contain substances and items, both of which have special packaging requirements. Some dangerous goods do not belong to hazardous chemicals, such as lithium batteries, batteries, matches, car airbags, etc.

In the classification principles of hazardous chemicals, some hazards have not been adopted by the classification standards for hazardous goods, so some hazardous chemicals, such as boric acid, are not classified as hazardous goods.

What is the commonly referred to "dangerous package certificate" in Chinese?

   Customs: "Dangerous Goods Certificate" is a common term, which accurately refers to the "Outbound Goods Transport Packaging Performance Inspection Result Form" issued after the packaging performance inspection is qualified, and the "Outbound Dangerous Goods Transport Packaging Use Appraisal Result Form" issued after the packaging use appraisal is qualified.

How to apply for a dangerous goods certificate?

   Customs: According to the Import and Export Commodity Inspection Law of the People's Republic of China and its implementation regulations, production enterprises exporting packaging containers for dangerous goods shall apply to the customs of the place of origin for performance appraisal of packaging containers for dangerous goods; Production enterprises exporting dangerous goods shall apply to the customs of the place of origin for the identification of the use of dangerous goods packaging containers.

Kind reminder:

   Exporting dangerous goods requires obtaining a "dangerous goods certificate"; The exported hazardous chemicals belong to dangerous goods and also require the application of a "hazardous package certificate".

   What are the scope and declaration points of export hazardous chemicals that need to be declared for inspection?

   Customs: Declaration scope: Hazardous chemicals listed in China's "Catalogue of Hazardous Chemicals (2015 Edition)" (HS codes and corresponding inspection and quarantine names related to hazardous chemicals are also provided in the attachment of the notice).

   Attention: Regardless of whether it is included in the Catalogue of Import and Export Commodities Subject to Inspection and Quarantine by Entry Exit Inspection and Quarantine Institutions, the hazardous chemicals listed in the Catalogue of Hazardous Chemicals should be truthfully declared to the customs and actively cooperate with the customs to inspect the import and export of hazardous chemicals and their packaging.

Declaration points: Before export, an electronic account should be applied for in the "Exit Inspection and Quarantine Application" module of a single window. During export declaration, an electronic account should be filled in the integrated declaration module of the export declaration form.

Kind reminder:

   The General Administration of Customs will update the Catalogue of Import and Export Commodities Subject to Inspection and Quarantine by Entry Exit Inspection and Quarantine Institutions before December 31st each year.

   What are the declaration materials that the shipper or its agent of exporting hazardous chemicals needs to provide?

   Customs: 1. Declaration of Conformity for Export Hazardous Chemical Production Enterprises;

                   2. Results of Performance Inspection for Transport Packaging of Outbound Goods (excluding bulk products and those exempted from using dangerous goods packaging according to international regulations);

                   3. Classification and identification report of hazardous characteristics;

                   4. Hazard announcement labels (excluding bulk products) and safety data sheet samples. If they are foreign language samples, corresponding Chinese translations should be provided;

                   5. For products that require the addition of inhibitors or stabilizers, an explanation of the actual name and quantity of the inhibitors or stabilizers added should be provided.

   Reminder: The above-mentioned 1-4 materials, which involve multiple declaration batches and require multiple uses of documents, are allowed to be provided by enterprises only during declaration. If they are to be reused in the future, and the customs need to verify the original documents, they should be provided as required. The second item, the Performance Inspection Results Form for Outbound Goods Transport Packaging, must be provided and verified by customs regardless of whether it is declared or not.

   What are the regulatory requirements for the inspection and supervision of import and export hazardous chemicals and their packaging?

   Customs: 1. The import and export of hazardous chemicals listed in the Catalogue of Hazardous Chemicals shall meet the following requirements:

   (1) Mandatory requirements for technical specifications in our country (applicable to imported products);

   (2) Relevant international conventions, rules, treaties, agreements, protocols, memorandums, etc;

   (3) Input or regional technical regulations and standards (applicable to exported products);

   (4) Technical specifications and standards designated by the General Administration of Customs and the General Administration of Quality Inspection;

   The inspection of import and export hazardous chemicals includes:

   (1) Whether the main components/component information, physical and chemical characteristics, hazard categories, etc. of the product comply with relevant regulations.

   (2) Is there a hazard warning label on the product packaging (imported products should have Chinese hazard warning labels), and is a safety data sheet attached (imported products should have Chinese safety data sheets); Does the content of the hazard disclosure label and safety data sheet comply with relevant regulations.

   3. For dangerous goods listed in the International Dangerous Goods Regulations (TDG) and the List of Dangerous Goods for export, packaging performance inspection and usage appraisal shall be carried out in accordance with the management regulations and standards for packaging inspection of dangerous goods exported by sea, air, road, and railway transportation.

   4. Export hazardous chemicals used as food and food additives should comply with relevant food safety regulations.

   Is it necessary to apply for an electronic ledger for goods with HS codes that involve hazardous chemicals but do not belong to the "Catalogue of Hazardous Chemicals (2015 Edition)" and do not have inspection and   quarantine supervision conditions?

   Customs: No need to apply for electronic ledger. Due to the situation where hazardous and non hazardous chemicals share the same HS code, if the enterprise confirms based on relevant identification reports that the goods do not belong to hazardous chemicals and the code does not have inspection and quarantine supervision conditions, it may not apply for an electronic ledger. When integrating export customs declaration, you can check "non hazardous chemicals" in the "dangerous goods information" editing interface.

   Is it necessary to conduct inspection in accordance with the requirements of Announcement No. 129 of the General Administration of Customs in 2020, as the goods intended for import by the enterprise are not within the scope of the "Catalogue of Hazardous Chemicals" in the "Catalogue of Hazardous Chemicals" (2015 Edition), but meet the requirements of the "Explanation" in the "Catalogue of Hazardous Chemicals" (2015 Edition)?

   Customs: Customs conducts inspections on the import and export of hazardous chemicals listed in the latest version of the Catalogue of Hazardous Chemicals.

   Do I need to apply for a "dangerous goods certificate" for lithium batteries when exporting equipment containing lithium batteries?

   Customs: According to the regulations of the United Nations TDG, it is necessary to consider the capacity of lithium batteries. If the capacity is large, a "dangerous goods certificate" is required, while if the capacity is small, it is not necessary to apply.

   According to the United Nations Recommendations on the Transport of Dangerous Goods, lithium batteries packaged in dangerous goods must be used: lithium metal batteries or lithium alloy batteries with a lithium content greater than 1 gram, and for lithium metal or lithium alloy battery packs, the total lithium content is greater than 2 grams; Lithium ion batteries have a rated watt-hour value exceeding 20W • h, and for lithium-ion battery packs, the rated watt-hour value exceeds 100W • h.
